1. Who you're contracting with
These Terms govern your use of the website, paid digital memberships, on-demand workout videos, digital training programs, downloadable guides, and free community features offered by Fitness in the Park ("we", "us", "our"). By creating an account, purchasing a digital membership or digital product, or otherwise using our services, you agree to these Terms.
2. Eligibility
You must be of legal age in your jurisdiction to enter into a contract, or have the consent of a parent or legal guardian. You confirm that any information you provide is accurate and that you will keep it up to date.
3. Accounts
You are responsible for keeping your login credentials confidential and for all activity that happens under your account. Notify us immediately at danariuscoleman2@gmail.com if you suspect unauthorized use.
4. The service
We provide a paid digital library of on-demand workout videos, structured training programs, downloadable guides, progress tools, and member community features. Free outdoor community meetups may be listed for awareness, but they are not sold, booked, or paid for through this website. Features may change as we improve the product. We do not guarantee uninterrupted, error-free, or always-available service.
5. Health disclaimer
Our content is general fitness information and is not medical advice. It is not medical, nutritional, diagnostic, or therapeutic advice and is not a substitute for a qualified healthcare professional. Consult a qualified physician before starting any exercise program. You use our content at your own risk.
6. Acceptable use
You agree not to misuse the service. Prohibited activities include unlawful use, fraud, spam, infringing third-party intellectual property, distributing malware, scraping, probing or interfering with our security, or attempting to gain unauthorized access. See our Acceptable Use Policy for details.
7. Intellectual property
All content on the site — including videos, training programs, downloadable guides, written materials, branding, and software — is owned by Fitness in the Park or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to access the content for personal, non-commercial use as part of your active membership or purchase. You may not copy, redistribute, resell, publicly perform, or create derivative works without our written permission.
8. Payments, billing & subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, currency, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms and our Refund Policy.
Memberships renew automatically at the end of each billing period until cancelled. You can cancel anytime from your dashboard; access continues through the end of the period you've already paid for.
9. Free community meetups
Free outdoor community meetups may be listed on the site for awareness. They are separate from paid digital products and are not sold, booked, or paid for through this website.
10. Suspension & termination
We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the service at any time.
11. Disclaimers
To the fullest extent permitted by law, the service is provided "as is" and "as available", and we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of liability
To the fullest extent permitted by law, our aggregate liability arising out of or related to the service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, special, incidental, or punitive damages, or for loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence where excluding such liability is not permitted.
13. Indemnity
You agree to indemnify and hold us harmless from claims arising out of your content, your unlawful use of the service, or your breach of these Terms.
14. Changes
We may update these Terms from time to time. Material changes will be communicated by email or via the site. Continued use after changes take effect constitutes acceptance.
15. Governing law
These Terms are governed by the laws of the State of Illinois, USA, and disputes will be resolved in the state or federal courts located in Cook County, Illinois, unless local consumer law requires otherwise.
